Notice on the Procedures to Include the Chemical Substances Already Produced or Used in China in the Inventory of Existing Chemical Substances in China

After the taking effect of the Provisions on the Environmental Management of New Chemical Substances (hereinafter referred to as the Provisions) on October 15, 2003, SEPA released the Inventory of Chemical Substances Already Produced in or Imported to China (hereinafter referred to as the Inventory) according to the Provisions. Before and after the promulgation of the Provisions, SEPA organized 6 times supplementary application for the Inventory. But at present, there're still some units in need of supplementary application. In order to have better separate management of new chemical substances and the existing ones and address the problem of some units missing the application, after due consideration, the Administration hereby notifies the following specific procedures required to add into the Inventory the chemical substances already produced or used legally in China before the Provisions taking into effect:

1.  The applicant files an application to local prefecture or city-level environmental protection bureau after downloading the application form from the website of Chemical Registration Center of SEPA (hereinafter referred to as CRC-SEPA, www.crc-sepa.org.cn) and filing them out as required. The application documents shall include explanations for the fact that the chemical substance was actually produced or used prior to the implementation of the Provisions and that it was not on the Inventory, as well as relevant certificates. The application form and specific requirements are in the Attachment.

2.  Environmental protection bureau at prefecture or city level check the authenticity of the documents submitted by the applicant.

3.  Provincial-level environmental protection bureau shall collect all the application forms within its administrative jurisdiction, and submit to SEPA the opinions for the first review and the enterprise's application documents.

4.  Upon the receipt of the documents submitted by the provincial-level environmental protection bureau, SEPA shall entrust the CRC-SEPA to verify and summarize the documents and present its suggestions.

5.  Based on the suggestions of the CRC-SEPA, SEPA departments concerned shall present their comments and report to SEPA leaders for a final decision.

6.  SEPA shall notify provincial-level environmental protection bureau and the CRC-SEPA on the final decision in a written form, and the latter shall notify the applicants.

Requirements for filling the form: ¡¡¡¡

1.  This is the technical form attached to the documents submitted by the applicant to local environmental protection bureau for the purpose of adding chemical substances into the Inventory. In the application text, the applicant shall specify the details and pledge to comply with the Provisions on the administration of new chemical substances and other regulations as well as the technical rules on adding new substances to the Inventory.

2.  It is recommended to acquire the accurate Chinese and English names, molecular formula, and structural formula of the chemical substances from relevant authorities, such as Chinese Chemical Society, in order to ensure their accuracy. If it is not convenient to put relevant information in the form, it may be provided in the attachment. To make it easier to look up and identify the chemical substances, their bynames, if any, may be distinguished by the semicolon.

3.  The type of operation refers to either production or use.

4.  Confidentiality of labels refers to "confidential" or "not confidential". In case of "confidential", the applicant is required to refer to the technical rules on adding chemical substances to the Inventory, and provide in attachments the Chinese generic name and English generic name as well as the confidentiality declaration.

5.  In the "list of Attachments", the applicant shall specify the documents attached to the application for adding the substances to the Inventory. The documents include the followings, A) evidence to prove the existence of the substances concerned before relevant regulations taking effect; B) explanations of authorities for the accurate Chinese and English names, molecular formula and structural formula of the substances concerned; C) in case of confidentiality, attachments on the generic name in both Chinese and English, and the confidentiality declaration; D)  attachments of molecular formula and structural formula that are not convenient to specify in the form.

6.  The applicant shall submit the application in both e-version and printed copies.
